Terms of Service

Introduction

Welcome to Gotcha. These Terms of Service ("Terms") govern your use of the Gotcha mobile application ("App") and services provided by Gotcha ("we," "us," or "our"). By accessing or using Gotcha, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Gotcha, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use Gotcha. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Gotcha for personal, non-commercial purposes.

You may NOT:

• Modify, reverse engineer, or decompile the App
• Use the App for any illegal or unauthorized purpose
• Remove any copyright or proprietary notices
• Attempt to gain unauthorized access to our systems
• Use the App to create content that violates others' rights
• Use the App to create misleading, defamatory, or harmful content
• Resell or redistribute generated content for commercial purposes without proper authorization

4. User Content

Your Responsibilities:

• You own the photos you upload to Gotcha
• You have the right to use and process these photos
• You will not upload content that infringes on others' rights
• You will not upload illegal, offensive, harmful, or inappropriate content
• You will not upload content depicting minors without proper authorization
• You will not use the App to create content that could be used to deceive, defraud, or harm others

Generated Content:

• You retain ownership of prank photos you create using Gotcha
• Generated content is stored in your account for your convenience
• You can delete any generated content at any time through the app
• Generated content is for personal, non-commercial use only unless otherwise authorized

5. Credits and Payments

Credit System:

• Gotcha uses a credit-based payment system
• Each prank photo generation costs 1 credit
• Credits are purchased through Apple's In-App Purchase system
• Credits do not expire as long as your account is active
• You receive 5 free credits when you first sign up
• You earn 1 free credit daily by opening the app
• You can earn 4 credits by referring a friend

One-Time Credit Purchases:

• Various credit pack sizes are available for purchase
• One-time purchases are non-refundable except as required by law

Payments:

• All payments are processed through Apple's App Store
• Prices are displayed in your local currency
• Refunds are handled according to Apple's refund policy
• Credits are non-transferable and non-refundable except as required by law

6. Service Availability

We strive to provide reliable service, but:

• Service may be temporarily unavailable for maintenance
• We do not guarantee uninterrupted access
• Prank photo generation times may vary based on demand and server load
• We reserve the right to modify or discontinue features
• We are not responsible for delays or failures due to third-party services (AI providers, payment processors, etc.)

7. Intellectual Property

Our Property:

The Gotcha App, including its design, features, code, and content, is owned by Gotcha and protected by copyright, trademark, and other intellectual property laws.

Your Property:

You retain all rights to the photos you upload and the prank photos you create using Gotcha.

8. Prohibited Activities

You agree NOT to:

• Use the App for any illegal purpose
• Upload content depicting violence, hate speech, illegal activities, or explicit material
• Attempt to circumvent payment systems or use unauthorized credits
• Interfere with other users' experience
• Use automated tools to access the service or generate excessive content
• Violate these Terms or any applicable laws
• Use generated content to mislead, defraud, or harm others
• Use generated content for harassment, bullying, or defamation
• Use generated content to deceive others in harmful ways
• Use generated content for commercial purposes without proper authorization

9. Account Termination

Your Rights:

You may delete your account at any time through Settings → Delete Account in the app. This will permanently delete your account and all associated data, including generated content.

Our Rights:

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. We may also suspend or terminate accounts that:

• Engage in fraudulent activity
• Attempt to abuse the credit system
• Upload inappropriate or illegal content
• Use generated content for harassment, bullying, or defamation
• Violate intellectual property rights
• Otherwise harm the service or other users

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Accuracy of AI-generated content
• Uninterrupted or error-free service
• Security of data transmission
• Compatibility with all devices or iOS versions

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOTCHA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM:

• Your use or inability to use the App
• Loss of data or content
• Your violation of these Terms
• Unauthorized access to your account
• Third-party actions or service failures
• Use of generated content in ways that violate these Terms or applicable laws

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Gotcha harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your content (uploaded photos or generated prank photos)
• Your violation of these Terms
• Your violation of any third-party rights
• Any misuse of generated content

13. Changes to Terms

We may modify these Terms at any time by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Notifying you of material changes through the app or via email

Continued use of Gotcha after changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the App and delete your account.

14. Privacy and Data

Your use of Gotcha is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

15. Governing Law

These Terms are governed by the laws of Turkey, excluding its conflicts of law rules. Any disputes will be resolved through binding arbitration or in courts of competent jurisdiction in Turkey.

16. App Store Terms

You acknowledge that:

• These Terms are between you and Gotcha, not Apple
• Apple has no obligation to provide support for Gotcha
• Apple is not responsible for the App or content
• You comply with all applicable third-party terms when using Gotcha
• Apple and its subsidiaries are third-party beneficiaries of these Terms

17. Auto-Renewable Subscriptions

If you purchase an auto-renewable subscription:

• Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• No refunds will be provided for any unused portion of a subscription period
• Subscription prices may change, but you will be notified in advance
